What to bring to the notary

  1. A valid identity card, national ID or passport bearing a photograph.
  2. The details set out above.
  3. For divorce as well as recognition and enforcement proceedings, two passport photographs taken within the last six months. A photograph must be affixed to the instrument in these matters; without it the power of attorney will not be accepted.
  4. For a power of attorney granted on behalf of a company, it is sufficient for the person authorised to represent it to attend the notary in person; the authority is verified electronically against the trade registry. If the authority has changed recently, bringing the relevant Trade Registry Gazette and the current tax certificate will speed matters up.

Scope of the instrument

A general litigation power of attorney, which also covers powers such as the collection of sums awarded and applications to the tax authorities, is sufficient at a minimum level for most matters. Certain acts, however, cannot be performed unless they are expressly stated in the instrument.

We therefore recommend that you contact us before the instrument is drawn up, so that the special powers your matter requires can be included in its text.

Granting a power of attorney from abroad

If you are outside Turkiye, you may grant the power of attorney at the Turkish consulate in the country where you are located. An instrument drawn up before a foreign notary must bear an apostille and be translated into Turkish by a sworn translator and certified before a notary.
